Welcome to Tek Analytics, LLC. (“Tek Analytics,” “we,” “our,” or “us”)! These User Terms of Service constitute a legally binding agreement (the “Agreement”) between you and Tek Analytics governing your access to and use of the Tek Analytics website, mobile application, products, and services provided by us (collectively, the “Service”).

By entering into this Agreement, and/or by accessing or using the Service, you expressly acknowledge that you have read, understood, and agree to be bound by this Agreement. This Agreement applies to all visitors, users, and others who access or use the Service (“Users,” “you,” or “your”). Tek Analytics reserves the right, at its sole discretion, to change, modify, add, or remove portions of this Agreement, at any time, by posting changes to this page. Your continued access to or use of the Service after such posting confirms your consent to be bound by this Agreement, as amended.

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THE SERVICE. THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION THAT INCLUDES A JURY TRIAL WAIVER AND CLASS ACTION WAIVER, AND A CLAUSE THAT GOVERNS THE JURISDICTION AND VENUE FOR ANY DISPUTES.

  1. Privacy Notice and Additional Terms

Our Privacy Notice explains how we collect, use, and share your information, and is hereby incorporated into this Agreement. You agree that your access to and use of the Service is governed by our Privacy Notice. Your use of the Service is subject to all additional terms, policies, rules, or guidelines applicable to the Service or certain features of the Service that we may post on or link to from the Service (the “Additional Terms”), such as end user license agreements for any downloadable software applications, or rules applicable to a particular feature or content on the Service. All Additional Terms are incorporated by reference into, and made a part of, this Agreement.

  1. Accounts and Registration

You have been designated as an authorized user by an organization or other third party (each, a “Customer”) that has a contract with us to use the Service (each, a “Customer Contract”). The Customer Contract contains our commitment to deliver the Service to Customer, who may then invite authorized users to join its instance of the Service. To access and use the Service you must create an account (“Account”) by providing us with information such as your name, contact information, and additional information you may elect to provide. You must provide accurate, current, and complete information during the registration process and keep your Account information up-to-date at all times. You are responsible for all activity that occurs in association with your Account. Tek Analytics is not liable for any loss or damage caused by your failure to maintain the confidentiality of your Account credentials. Please contact us at the email below if you discover or suspect any security breach related to the Service or your Account. When you submit content or information to the Service (“User Content”), you acknowledge and agree that User Content is owned by Customer and the Customer Contract sets forth all right in and to User Content. You may not submit any information that identifies or would enable the identification of any patient. We reserve the right (but not the obligation) to reject and/or remove any User Content that we believe, in our sole discretion, violates this Agreement.

  1. Restrictions

In addition to any other restrictions set forth in this Agreement, you agree not to engage in, attempt to engage in, or permit or assist others in engaging in, any of the following prohibited activities: (i) use any software, script, code, device, crawler, robot, or other means not provided by us to access the Service; (ii) circumvent, disable, or otherwise interfere with security-related features on the Service; (iii) modify, adapt, translate, reverse engineer, decipher, decompile, or otherwise disassemble any portion of the Service; (iv) access or use the Service in any manner that may damage, disable, unduly burden, or impair any part of the Service, or any servers or networks connected to the Service; (v) post information or interact with the Service in in a manner which is fraudulent, libelous, abusive, obscene, profane, harassing, or illegal; (vi) use the Service for any illegal purpose or in violation of any law, statute, rule, permit, ordinance or regulation; (vii) gain or attempt to gain unauthorized access to the Service; (viii) interfere or attempt to interfere with the Service provided to any user or network, including, without limitation, via means of submitting a virus to the Service, spamming, crashing, or otherwise; (ix) engage in commercial use or distribution of the Service, or copy or create any derivative work of the Service; (x) use the Service in any way that infringes or misappropriates any third party’s rights, including intellectual property rights, copyright, patent, trademark, trade secret, or other proprietary rights, or rights of publicity or privacy; or (xi) use your Account or the Service for the benefit of any third party, other than Customer.

  1. Disclaimer

YOU ACKNOWLEDGE AND AGREE THAT BETWEEN CUSTOMER AND TEK ANALYTICS, IT IS SOLELY CUSTOMER’S RESPONSIBILITY TO: (i) INFORM YOU AND ANY AUTHORIZED USERS OF ANY RELEVANT CUSTOMER POLICIES AND PRACTICES AND ANY SETTINGS THAT MAY IMPACT THE PROCESSING OF USER DATA; (ii) OBTAIN ANY RIGHTS, PERMISSIONS, OR CONSENTS FROM YOU AND ANY AUTHORIZED USERS THAT ARE NECESSARY FOR THE LAWFUL USE OF USER DATA AND THE OPERATION OF THE SERVICE; (iii) ENSURE THAT THE TRANSFER AND PROCESSING OF USER DATA UNDER THE CUSTOMER CONTRACT IS LAWFUL; AND (iv) RESPOND TO AND RESOLVE ANY DISPUTE WITH YOU AND ANY AUTHORIZED USER RELATING TO OR BASED ON USER DATA, THE SERVICE, OR CUSTOMER’S FAILURE TO FULFILL THESE OBLIGATIONS. TEK ANALYTICS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, RELATING TO THE SERVICE, WHICH ARE PROVIDED TO YOU ON AN “AS IS” AND “ AS AVAILABLE” BASIS.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEK ANALYTICS OR ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM THE USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF TEK ANALYTICS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES. NOTWITHSTANDING THE FOREGOING, THE TOTAL LIABILITY OF TEK ANALYTICS AND ITS LICENSORS, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE), PRODUCT LIABILITY, STRICT LIABILITY, OR ANY OTHER THEORY, ASSOCIATED WITH ANY CLAIM ARISING OUT OF OR RELATING TO USE OF OR ACCESS TO THE SERVICE FOR ANY REASON WHATSOEVER SHALL BE LIMITED TO ONE HUNDRED DOLLARS ($100). IF THE JURISDICTION YOU ARE IN DOES NOT ALLOW FOR THE EXCLUSION OF CERTAIN TYPES OF DAMAGES, THEN SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN CERTAIN CIRCUMSTANCES.

The Service is a workplace tool intended for use by businesses and organizations and not for consumer purposes. To the maximum extent permitted by law, you hereby acknowledge and agree that consumer laws do not apply. If however any consumer laws in any jurisdiction do apply and cannot otherwise be lawfully excluded, nothing in this Agreement will restrict, exclude, or modify any statutory warranties, guarantees, rights, or remedies you have, and our liability is limited (at our option) to the replacement, repair, or resupply of the Service.

  1. Alerts and Notifications

By entering into this Agreement or using the Service, you agree to receive communications from us, including e-mails, text messages, alerts, and other electronic communications. Standard message and data rates apply to all messages sent to or received from us. Any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that the communication be in writing.

  1. Dispute Resolution

PLEASE READ THE FOLLOWING SECTION CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE CERTAIN DISPUTES AND CLAIMS WITH US AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM US.

The parties shall use their best efforts to settle any dispute, claim, question, or disagreement directly through consultation and good faith negotiations, which shall be a precondition to either party initiating a lawsuit or arbitration. If the parties do not reach an agreed upon solution within a period of thirty (30) days from the time such informal dispute resolution is pursued, then either party may initiate binding arbitration. Except as expressly set forth herein, any dispute, claim, or controversy (each, a “Claim”) arising out of or relating to this Agreement will be settled by binding arbitration administered by the American Arbitration Association (the “AAA”) in accordance with the provisions of its Commercial Consumer Arbitration Rules and the supplementary procedures for consumer related disputes of the AAA, excluding any rules or procedures governing or permitting class actions. The arbitrator, and not any federal, state or local court or agency, shall have exclusive authority to resolve all disputes arising out of or relating to the interpretation, applicability, enforceability, or formation of this Agreement, including, but not limited to any Claim that all or any part of this Agreement is void or voidable. The arbitrator’s award shall be binding on the parties and may be entered as a judgment in any court of competent jurisdiction. The procedures and rules of the Federal Arbitration Act, 9 U.S.C. § 1, et seq. shall exclusively govern the interpretation and enforcement of any arbitration. The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.

You and Tek Analytics each acknowledge and agree to waive the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Any arbitration will be conducted only on an individual basis and not in a class, collective, consolidated, or representative proceeding. However, you and Tek Analytics each retain the right to bring an individual action in small claims court or the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyright, trademark, trade secret, patent, or other intellectual property right. If any court or arbitrator determines that the foregoing class action waiver is void or unenforceable for any reason or that an arbitration can proceed on a class basis, then the arbitration provision herein shall be deemed null and void in its entirety and the parties shall be deemed to have not agreed to arbitrate disputes.

In addition to the severability provisions set forth above, in the event that any portion of this arbitration provision is deemed illegal or unenforceable, such provision shall be severed and the remainder of this section shall be given full force and effect. Any Claim or cause of action you may have arising out of or relating to this Agreement or the Services must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred. The parties specifically exclude from application to this Agreement the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act.

  1. General

Except as provided in Section 7 above, this Agreement is governed by the laws of the State of Illinois, without regard to conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within Chicago, Illinois for the purpose of litigating any dispute. You may not assign or transfer this Agreement or your rights herein, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign this Agreement at any time without notice or consent. If any portion of this Agreement is held invalid, you agree that such invalidity will not affect the validity of the remaining portions of this Agreement. No waiver by Tek Analytics of any breach or default of this Agreement will constitute a continuing waiver of such breach or default or be deemed to be a waiver of any preceding or subsequent breach or default. This Agreement represents the complete agreement between Tek Analytics and you regarding the subject matter set forth herein and supersedes all prior agreements and representations between Tek Analytics and you. This Agreement remain effective until Customer’s subscription related to your use of the Service expires or terminates, or your Account has been terminated by Customer or us in accordance with this Agreement. Please contact Customer if you wish to terminate your Account.

Tek Analytics Limited, its subsidiaries and branch operations hereinafter referred as ‘Tek Analytics’, ‘we’, ‘us’ or ‘our’ is committed to respect your privacy and choices. The privacy statement highlights our privacy practices regarding Personal Information that we collect and process depending on your association with Tek Analytics and nature of processing activity in compliance to applicable data privacy regulations.

  • Information that you provide via our website, including information you provide when you register on our website e.g. name, email address, designation, company, country, name of your university, your field of academic study/concentration, expected year and month of your graduation, and telephone number;
  • Information about your computer and about your visits to and use of this Site, such as your Internet Protocol (IP) address, demographics, your computers’ operating system, and browser type and information collected via cookies
  • Cookie related details are provided in the Cookie Policy

I.2. Use of your Personal Information

We use your Personal Information for the following purposes:

  • to provide better usability, troubleshooting and site maintenance;
  • to understand which parts of the website are visited and how frequently;
  • to create your user ID;
  • to identify you once you register on our website;
  • to contact you and respond to your questions or requests; and
  • to provide access to desirable content based on your preferences.
  • to process job application and alumni related requests, more details about which are available on corresponding portals of this website.
  • To know your interest of participation in ideathons or other competitions
  • As a participant of the competition, to publish your name and corresponding details to make them available to larger audience on the Internet

I.3. Legal basis of the processing

We process your Personal Information when it is necessary for the performance of a contract to which you are the party or in order to take steps at your request prior to entering into a contract. This applies in any case where we provide services to you pursuant to a contract, such as when you use our website or process your registration on the website. If you do not provide the Personal Information that we need in order to provide our services, we will not be able to provide our services to you. We process your Personal Information for the performance of a contract in the following circumstances:

  • to provide better usability, troubleshooting and site maintenance; and
  • to create your user ID.

We process your Personal Information when it is necessary for the purposes of a legitimate interest pursued by us or a third party (when these interests are not overridden by your data protection rights). This applies in the following circumstances:

If you choose not to provide your Personal Information that is mandatory to process your request, we may not be able to provide the corresponding service.

Tek Analytics does not share your Personal Information with third parties for their direct marketing purposes.

We share your Personal Information within

  • Tek Analytics or with any of its subsidiaries;
  • Business partners;
  • Service vendors;
  • Authorized third-party agents; or
  • Contractors.

Tek Analytics Limited does not sell your Personal Information to third parties.

In general, Tek Analytics Limited, domiciled in Bangalore, is the data controller processing your Personal Information. The following applies only where the data controller processing your Personal Information is domiciled in the European Economic Area (“EEA”):

We transfer Personal Information to countries outside the EEA to third parties, including to countries which have different data protection standards to those which apply in the EEA. The locations of Tek Analytics group companies is set out here. Our service providers are primarily located in USA, Canada, Australia, Singapore, Hong Kong, India and UK. Where service providers process your Personal Information in countries deemed adequate by the European Commission, we rely on the European Commission’s decision to protect your Personal Information.

For transfers to Tek Analytics group companies and service providers outside the EEA, we use standard contractual clauses or rely on a service provider’s (EU data protection authority approved) corporate rules that are in place to protect your Personal Information. Please contact us as set out below if you would like to obtain a copy of the methods used. When required, Tek Analytics discloses Personal Information to external law enforcement bodies or regulatory authorities, in order to comply with legal obligations.

Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, Tek Analytics Limited and the Site do not recognize DNT.

Subject to the laws of your country, You have the right to access, correct, delete or transfer your Personal Information that we hold, including your profile and preferences. You also have the right to object to certain processing and, where we have asked for your consent to process your Personal Information, to withdraw this consent. Where we process your Personal Information because we have a legitimate interest in doing so (as explained above), you also have a right to object to this. These rights may be limited in some situations – for example, where we can demonstrate that we have a legal requirement to process your Personal Information.

If you are Brazilian user, you have additional rights to take confirmation on existence of your personal information, portability of your personal information to another service provider if applicable, anonymization or blocking of unnecessary information, information about public and private entities with which we have shared your data.

VII. Your California Privacy Rights

California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information. As discussed elsewhere in this Privacy Policy, we do not currently share the personal information of California residents with third parties for their own direct marketing purposes. However, if you have further questions about our privacy practices and compliance with California law, please contact us as explained below.

Tek Analytics adopts reasonable and appropriate security practices and procedures including administrative, physical security, and technical controls in order to safeguard your Personal Information.

  1. Data retention

Personal Information will not be retained for a period more than necessary to fulfill the purposes outlined in this privacy statement, unless a longer retention period is required by law or for directly related legitimate business purposes.

  1. Contact your Local Data Protection Authority

Depending on the laws of the countries where you reside, if you are unhappy with how we safeguard your personal data, you have the right to bring a complaint to your local data protection authority.

  1. Linked websites

Our privacy practices regarding Personal Information that we collect and store about you through our portals such as Recruitment and Global Alumni will be as per the privacy policy of those portals.

Tek Analytics provides links to third-party websites and services. However, Tek Analytics is not responsible for the privacy statements, practices, or the contents of such third-party websites.

XII. Children’s Privacy

The Site does not knowingly solicit or collect personally identifiable information online from children under the age of 13 without prior verifiable parental consent. If Tek Analytics Limited learns that a child under the age of 13 has submitted personally identifiable information online without parental consent, it will take all reasonable measures to delete such information from its databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). Minors under 18 years of age may have the personal information that they provide to us deleted by sending an email to privacy@Tek Analytics.com requesting deletion. Please note that, while we make reasonable efforts to comply with such requests, deletion of your personal information does not ensure complete and comprehensive removal of that data from all systems.
